This workshop is tailored for legal professionals, corporate counsels, and business managers dealing with commercial disputes. It bridges theory with practical tools necessary for conducting and participating in arbitration. Organized by the Nepal Bar Council in collaboration with Nepal International ADR Center (NIAC), the workshop involves mock arbitration sessions, clause drafting activities, and discussion forums.
The workshop begins with an overview of arbitration law in Nepal and introduces participants to the procedural framework set by the Arbitration Act. Facilitators will walk through the typical lifecycle of an arbitration, from agreement to award, integrating local case studies.
A core part of the day will focus on simulated roleplay involving a commercial lease dispute. Participants will assume the roles of claimant, respondent, arbitrators, and witnesses. This interactive session aims to build confidence in oral argumentation, evidence handling, and tribunal dynamics.
Following the simulations, sessions will be held on drafting effective arbitration clauses, choosing arbitration seats, and managing costs. Discussions will also touch upon hybrid mechanisms like med-arb.
Guest speakers will include corporate lawyers and arbitration consultants from India and Sri Lanka, who will provide cross-border perspectives. Practical materials such as sample notices, arbitration rules, and award templates will be distributed.
Attendees will also participate in a feedback panel, sharing their learning experience and suggesting further topics for future workshops. A post-event online forum will remain open for continued peer discussion and mentoring.
Certificates and CPD points will be awarded to participants, making this a valuable addition to professional development portfolios.
